LOUISIANA STATE BOARD OF COSMETOLOGY
PUBLIC HEALTH EMERGENCY DECLARATION
WHEREAS, on Thursday, March 19, 2020, Governor John Bel Edwards "[i]n an effort to reduce and limit the spread ofCOVID-19 in Louisiana, and to preserve the health and safety of all members of the public" issued Proclamation No. 32-JBE-2020 entitled "Additional Measures for COVID-19 Public Health Emergency;
WHEREAS, Section 4 of Proclamation No. 32-JBE-2020 authorized "all Public Postsecondary institutions and proprietary schools within the state of Louisiana that are licensed by the Louisiana Board of Regents" to substitute "in-person clinical and classroom instruction with online and lab simulations for enrolled students for the duration of the declared emergency;"
WHEREAS, on Sunday, March 22, 2020, Governor Edwards "in line with guidance from the Centers from Disease Control (CDC) and after consultation with the State Health Officer and Director of the National Institute of Allergy and Infectious Disease," determined "it is clear that additional measures are necessary to protect the health and safety of the public, to mitigate the impact of COVID-19, and to disrupt the spread of the virus," and issued Proclamation No. 33-JBE-2020 entitled "Additional Measures for COVID-19 Stay at Home effective 5:00 p.m. on Monday, March 23, 2020 to Friday, May 15, 2020, unless terminated sooner;
WHEREAS, Section 2 of Proclamation No. 32-JBE-2020 states,"[i]n an effort to reduce and limit the spread of COVID-19 in Louisiana, and to preserve the health and safety of all members of the public, all gatherings of 10 people or more shall be postponed or cancelled;"
WHEREAS, Section 4(A)(2) of Proclamation No. 32-JBE-2020 requires "[a]II personal care and grooming businesses, including but not limited to "beauty salons, nail salons, spas ... and other similar businesses" to be closed to the public; and
NOW THERFORE, the Louisiana State Board of Cosmetology seeks to support and cooperate in actions taken by Governor Edwards in response to the effects of this Public Health Emergency;
IT IS HEREBY ORDERED that all salons licensed by the Louisiana Board of Cosmetology including but not limited to salons known as hair salons, day spas, waxing studios, esthetics clinics, nail salons, salon suites, mobile salons and blow dry bars and the clinics at cosmetology and esthetics schools shall be closed to the public and shall cease and desist performing cosmetology on the premises effective at 5:00 p.m. on March 23, 2020 until Friday, May 15, 2020, unless Proclamation No. 33-JBE-2020 is terminated sooner;
IT IS HEREBY FURTHER ORDERED that all cosmetology and esthetic schools licensed by the Louisiana State Board of Cosmetology are authorized to substitute "in-person clinical and classroom instruction with online and lab simulations for enrolled students for the duration of the declared emergency; and
IT IS HEREBY FURTHER ORDERED that the Louisiana State Board of Cosmetology's inspectors are authorized to enforce the provisions of this order while maintaining social distancing; however, inspectors shall not enter any building with 10 or more people present.
